If a trademark application is initially refused, the U.S. Patent and Trademark Office will issue what is called an Office Action. An Office Action is not a denial of the application, but rather a formal notice identifying issues that must be addressed before the mark can proceed to registration. These issues may include technical corrections, requests for clarification, which are included in your trademark fee. More substantive concerns such as a potential likelihood of confusion with an existing mark will incur an additional charge for responses. Most Office Actions are routine, and many applications move forward successfully after a timely and well-crafted response.
